These Terms of Service (“Terms”) govern your use of dentalcreationsinc.com (the “site”), operated by Dental Creations, Inc. (“Dental Creations,” “we,” “us” or “our”), including the contact form and online case submission. By using the site you agree to these Terms and to our Privacy Policy and Refund Policy. If you do not agree, please do not use the site. Where your practice has a separate written agreement or account terms with us, that agreement controls if it conflicts with these Terms.

1. Who the site is for

The site is intended for licensed dental professionals, their practices and authorized staff. By submitting a case or inquiry, you confirm that you are a licensed dental professional or are authorized to act on behalf of one, and that you are at least 18 years old. We do not provide services directly to patients.

2. Information on the site

Content on the site, including Lab notes articles, product descriptions and turnaround estimates, is general information for dental professionals. It is not clinical advice for a specific patient. Product availability, materials and specifications may change. We work to keep the site accurate but do not guarantee that every detail is current.

3. Prescriptions and clinical responsibility

Every restoration we make is fabricated to the written prescription of a licensed dentist. Diagnosis, treatment planning, material selection for the patient, preparation, try-in, adjustment, cementation and delivery are the responsibility of the prescribing dentist. We may recommend materials or designs and point out concerns with a prescription, but the final clinical decision is yours. We may decline any case we believe cannot be made to an acceptable standard as prescribed.

4. Online case submission

When you submit a case or upload files, you agree that:

You are authorized to share the information and files, including any patient information, with Dental Creations for the purpose of fabricating the prescribed restoration.
You will share only the patient information needed for the case, using initials or a case ID where possible.
The prescription, scans, impressions, bite records, photos and other materials you provide are accurate and complete, and you will confirm any details we ask about before fabrication.
Your files do not contain malicious code and do not infringe anyone else’s rights.

Submitting a case online is a request for service. A case is accepted once we have reviewed it. We may decline or hold a case that is incomplete, unclear or outside the services we offer, and we will contact you if we need more information. The due date on a case runs from when we have everything needed to start. Turnaround times on the site are typical, not guaranteed; rush service depends on lab capacity and is confirmed directly with you. We are not responsible for delays or results caused by files that are corrupted, incomplete or incompatible, by inaccurate prescriptions, impressions or bite records, or by components that arrive late or do not match the prescription.

5. Accounts, pricing and payment

Prices, payment terms and any credit arrangements are set out in our current fee schedule or your account terms, which we provide on request. Prices may change; the price that applies is the one in effect when we accept the case, unless we agree otherwise in writing. Invoices are due as stated on the invoice. You are responsible for keeping your practice’s contact, billing and delivery details current.

6. Warranty and remakes

We stand behind the quality of our work. If you are unsatisfied with the fit or function of a restoration, contact us promptly for review. Remakes, adjustments, credits and refunds are handled under our Refund Policy and our quality and warranty guidelines. We determine the eligibility and scope of a warranty claim after reviewing the case, and we may ask for the restoration, models or scans to be returned for evaluation.

7. Shipping, pickup and delivery

We offer local pickup and delivery in the Greater Boston area. Cases shipped outside our delivery area are sent with reputable carriers. Risk of loss passes to you when a case is handed to you, your staff or a carrier you choose. We are not responsible for delays, damage or loss caused by third-party carriers, but we will make reasonable efforts to help resolve any issue. You are responsible for providing accurate shipping addresses and handling instructions and for disinfecting impressions and returned items before they come to the lab.

8. Electronic communications

By using the site you agree that we may communicate with you electronically, including case confirmations, questions about a prescription and invoices, and that these messages satisfy any requirement that a communication be in writing. Email is not a guaranteed or fully secure channel; please use the online case form rather than email attachments for scans and patient details where you can.

9. Acceptable use

You agree not to misuse the site, including by attempting to gain unauthorized access, probing or testing its security without permission, interfering with its operation, uploading malicious files, using automated tools to submit forms, or submitting false, misleading or unlawful content. We may block access or refuse submissions that violate these Terms.

10. Intellectual property

The site’s content, including its text, design, logos and images, belongs to Dental Creations, Inc. or its licensors and may not be copied or reused without written permission. You keep ownership of the files and information you submit, and you give us permission to use, store and copy them as needed to provide our services and keep our records. We may keep digital designs we create for your cases so we can make remakes and matching work.

11. Third-party services and links

We use third-party providers to host the site, deliver email and measure site use, as described in our Privacy Policy. Links to other websites, such as map directions and review pages, are provided for convenience, and we are not responsible for their content or practices.

12. Disclaimer of warranties

The site is provided “as is” and “as available.” To the extent permitted by law, we make no warranties about the site’s availability, accuracy or completeness, and we do not warrant that it will be uninterrupted or error-free. This does not limit the warranty on our restorations described in section 6.

13. Limitation of liability

To the maximum extent permitted by law, Dental Creations, Inc. is not liable for any indirect, incidental, special or consequential damages, or for lost profits or lost chair time, arising from your use of the site or our services. Our total liability for any claim relating to a case is limited to the amount you paid for that case. Nothing in these Terms limits any liability that cannot be limited under applicable law.

14. Indemnification

You agree to indemnify and hold harmless Dental Creations from claims arising from the information, prescriptions and files you submit, your clinical decisions, or your breach of these Terms, except to the extent a claim is caused by our negligence or a defect in our work.

15. Events outside our control

We are not responsible for delays or failures caused by events beyond our reasonable control, such as severe weather, power or internet outages, carrier delays, supplier shortages or public health orders. We will let you know as soon as we can if one of these affects your case.

16. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve the issue informally. Any dispute that cannot be resolved will be brought in the state or federal courts located in Suffolk County, Massachusetts.

17. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms without our written consent. These Terms, together with the policies linked above and any written account agreement, are the entire agreement between us about the site.

18. Changes

We may update these Terms from time to time. The effective date at the top of this page shows when they were last revised. Changes apply to cases submitted after the change. Continued use of the site after a change means you accept the updated Terms.
